Do I have to file a lawsuit?

Not necessarily. Some personal injury claims can be resolved by negotiating a settlement agreed upon by both parties. If a settlement is reached, there is no need for a court appearance or trial.

What are some of the more common personal injury claims?

A personal injury claim can arise in almost any circumstance in which someone suffers an injury but the more common situations we generally see include car accidents, slips and falls, certain construction work type of accidents, medical claims arising from injuries during the course of or from medical treatment, and injuries sustained in nursing homes. How long do I have to file a lawsuit or bring a claim?

Generally, most personal injury claims have to be brought within 3 years. However, depending upon the entities involved, certain paperwork such as a no-fault application could have to be submitted within 30 days and other entities are entitled to receive written notice of your claim within 90 days. Other situations, involving medical claims, have different time requirements as well.
